  1. I would be very careful if judicial review is more or less a new or untried thing in UK. Once you allow too much of it, the judiciary becomes lord over all other branches of government. It's certainly no longer co-equal in the US. Circuit Court judges can stop executive orders regardless of legal precedent, and the only check on that seems to be yet another level of courts. I kind of for the Andrew Jackson approach of acknowledging the court's opinion, then challenging it to enforce that opinion.
