It’s not unknown. If you phone the council EARLY they will tel you about section 13a. If you leave it until liability orders are made (as many do) it’s too late.

You demonstrate a simpleton’s misunderstanding of how law works. The Council Tax A & E regulations order your council to collect said tax from liable parties. They also order your local council to pursue defaulters using a quite specific mechanism contained in the act. Your notion that a law “tells you” to pay tax (or do anything else) is infantile.

Wrong act. The act you’re (trying to) refer to is the Local Government Act of 1888 and the “paragraph” you’re probably referring to is simply transferring debts, responsibilities and obligations of the old local authorities onto the newly created County Councils.

@hunterfiona1 The law doesn’t say “you have to pay.” The law says councils are OBLIGED to levy and collect CT from liable residents and goes on to describe enforcement action they can take to fulfil this obligation. No law says “you must do X, Y or Z - that would be a commandment.

@ef7480 As utility bills are largely payable after usage there are certain types who see this as an opportunity to default on paying using spurious arguments. If MacDonalds, the off licence or the local corner shop allowed similar arrangements these people would be exactly the same with their responsibilities there claiming the right to free food, booze and scratch cards. They’re essentially the parasites the rest of us have to pay for because the rules on forcible sterilisation protect them.

@pamelahall9459 Not sure what you mean by a “judge” as CT liability hearings are heard in magistrates courts and paying them what you think you can afford is of no relevance to the court. The hearing simply looks at whether the money is owed and whether the council has performed its legal obligations correctly. What you can afford must be negotiated with the council ideally before the summons is issued.

He doesn’t need to as he’s read the act. If you haven’t, or don’t understand it you can contact them yourself of simply go to the government website which clearly shows the obligations, duties and powers the billing authority has on the subject of council tax.

13a merely gives the council a minimal amount of discretion. Unfortunately as they’re continually underfunded it doesn’t often work.

@maskedavenger2578 I’m not implying anything. Simply explaining the law (as it is and not as you imagine it) explicitly allows certain authorities to send out summonses to debtors with the approval of the court. I don’t even understand where you get the notion that this is somehow wrong. Incidentally claiming to have received a multitude of summonses over the course of your life really isn’t something to make one swell with pride. More trustworthy people might even be somewhat ashamed of the fact.

@MrArthand The P60 isn’t some sort of “opt out” document. It’s merely a piece of paper that must be given to you by your employer showing your income and PAYE/NI payments for the previous year. There’s no box to tick and it has no relevance to what you pay the following year. How do you make this stuff up? Why do you make this stuff up?
