@Snivy-Wizard-Nattie fortunately you don’t need to negotiate the terms of fair use - what you described is not it. “Fair” is not the operating word In the legal footing of the definition. Fair use is an incredibly rare exception. It’s WELL beyond reactions content. Quite a lot of pictures and videos too shown on other people’s videos are used without consent. Thus there’s a chunk that are likely in violation of copyright . Just bc it stays up doesn’t make it legal. What many don’t see is the hard work to acquire a license to show things . And so when YouTubers begin, they don’t know about license free databases and how to navigate. Eg I hear a lot how if something is already on the platform it’s fair to talk about. Patently not true. I invest hundreds of dollars for certain subscriptions and even sometimes as much for 12 seconds of footage. We just don’t talk about that. The better way to describe fair use if someone were an up and coming content creator is: 1. Is it your footage/picture? 2. Did you get expressed permission? One of those should be yes. Now sure yes some commentary is perfectly legal. But again fair use is very tight . Another more tangible way to measure is if I took out every single part of the original content when it’s on screen or heard, would your video still mostly make sense ? It not, then under strict application it wouldn’t comply.
