  1. And let us not forget South Dakota vs Wayfair, which threw in the toilet the clause in the Constitution that states that there will be no interstate sales tax. The clause is very clear, but SCOTUS ripped it out and threw it away. If you're in ecommerce, you know what a hornets nest they created. 10,000 sales tax districts, constantly changing, but every individual entrepreneur is responsible for knowing and complying with all of them. Yay!

This is what people don't understand about the US Constitution; every time SCOTUS makes a decision, or lets a lower court decision stand, that is counter to the Constitution, that precedent CHANGES the Constitution in a practical way. Retroactive laws are unconstitutional, but SCOTUS let it stand when Clinton did it, so now it's Constitutional.
