  1. That is the law in my state. Whatever belonged to the a person before marriage remains theirs even if the couple divorces. Inheritances are also the property of the individual and not joint property, no matter when the person received the Inheritance. Only assets acquired during the marriage are considered joint property. One exception is if the assets are co-mingled; for instance, you put inherited money in a joint bank account. Also, the house you live in during the marriage can become joint property even if purchased before marriage. I'm still not clear about the exact rules on that.

  2. It's the law in my state. The only marital property is what you earned or bought during the marriage. Even inheritances don't count. Debts are separate, too, unless they are joint debts, like a joint mortgage or joint credit card.
