No, that’s not what they’re saying. The constitution states that you have the right to remain silent. So if someone exercises their right not to talk to cops like he did, that can’t be used against them in court. As a result, the judge ordered that video of him refusing to speak to cops to be muted so the jury doesn’t infer anything negative from the fact that he wasn’t willing to talk to them. You cannot be punished for exercising your constitutional rights and that includes juries holding it against you for not speaking to cops.

@Jw-cb5se that is not correct “you have the right to remain silent, your words can and WILL be used against you”. You cannot take back something you said to cops unless you were not read your Miranda rights AND you’re under arrest. Then the cops violated your rights and then you can seek to keep that out of the courtroom, which had happened before. This was muted because he had a right to not talk and he chose to exercise it.

@Jw-cb5se not if you wave it!! If he were to have admitted to 💀 her in that moment, he cannot later say “well I want that scrubbed from evidence because NOW I want to remain silent”. So no- you can’t use it retroactively. The Miranda rights even specify that anything you say or do WILL be used against you. That’s why lawyers tell people to stfu
