No 15 will absolutely bet the Jetta driver was on the phone on either FB or WA, and a look at their phone data logs will show this being consistent from the time they got on the freeway as well, up to the crash. Could result in them not only getting charged with negligence, but also with them getting a suspension, if not having the license revoked. Submitter can easily get a civil case from this footage, and claim back all the costs not covered by insurance, like hospital bills, lost time, rental costs and even for therapy and long term injury treatment.

Yes, but with a clear view of the vehicle deliberately polluting, they can send the video to the local traffic police, and they will very likely impound the truck for inspection, and give him a fine for deliberately defeating an anti pollution device.

Other driver can also claim for lost time as well, plus a rental Tesla while his is in the shop. If a judge says this is deliberate and he has prior records he might award treble damages as well, just to drive the point home.

@mundanestuff They hit for sure, jeep is prone to roll over because of height, but airbags already deployed means they hit the rear of the other vehicle, hard, and were launched up from the side by that impact. Likely wheel hit the other car on the side, and rode up it.

But he did merge behind the truck, and then entered the turn lane before being deliberately cut off. Truck driver is fully at fault here, and hopefully is charged both with reckless driving and criminal assault with a weapon as well, and is taken off the road for a few years as well. All his actions were both deliberate, and could easily have resulted in serious injury to the other driver.

Send to the insurers and let them all file suit against the cause, and see how they like having multiple suits filed against them using the video evidence. As their insurer likely will pay out, and file suit against the driver as well, they will absolutely not be doing road rage in the future, as they will be walking to get around, because no car and no house.

@webcomment8895 Low speed impact, vehicle was stopped so the airbags did not go off. Airbags are not made by Tesla, they contract the entire airbag and controller out to a specialist supplier, like Bosch, so use the standard deployment impact forces. You had the impact cause injury, but the primary restraint system (seatbelt) did prevent him getting serious injury, and the passive safety systems (crumple zones) absorbed the majority of the impact as well. If the airbags went off for every similar energy event, you would find them going off on things like hitting a kerb, braking hard, hitting a speed bump over the listed speed, or even a shopping trolley hitting the front. Would you like to have your airbags deploy like that old meme of the car honking at an old lady crossing slowly, and then she hit the front of the vehicle with her handbag, triggering the airbags?

Or it was close to end of shift, so why get into overtime (likely unpaid as well) for a ticket that probably will be dropped by the DA when the other driver pleas poverty, or that they were not guilty.

Tesla, where they control both parts supply, and if you use them for insurance you also have to use their body shops. that $12k is more than I have paid for motor vehicles my entire life added up. I can buy a new vehicle by me for less than that amount.

Right on red in an accident is still classed as red light running, so will get a good chunk of the blame still, as after all they deliberately disregarded a lawful instruction to stop, and did not check the intersection was clear before entering.

Plus in full HD video as well, likely to be a video played at the insurer office to all staff as a "look at this bonehead here". Has to now pay for the damage to their own vehicle, the damage to the Tesla, and likely also got a lovely ticket from the local traffic department for an illegal overtake as well.

You can bet, with this clear video, that she is being roundly criticised on social media now, as with a time and location, there is bound to be a few viewers in the area who recognise the airhead. Plus could also be charged with vandalism, and forever banned from the mall as well.

Yes send the repair bill to their insurer, and file a police report for malicious damage to property, and as the damage will definitely exceed the criminal threshold the company will be both paying for the damage, and also be sitting in front of a magistrate or judge to explain, with full video as well, exactly why they should not be found guilty, and have to pay. Accident would be if he was doing the entire road, but this is deliberate aiming, and also shows intent, in that it was done separately from any other work, and was also done by trespassing into the yard as well, off the mandated road clearing only.

@1dariansdad Get a lawyer, they put a motion before a judge for cellphone location and metadata (remember this is not classed as personally protected data specifically by the US Supreme court, as it is classed as data used by the phone companies internally for billing purposes, so is not protected speech) which will give them all the details for that day. Then at endpoints and traffic cameras simply request footage, and see the renter was driving. Then the civil case goes ahead, plus the renter now also has, after losing the civil case, now additional charges of making false statements to the police, plus insurance fraud, and a few others that can be tacked on. then will also have to pat for the damage to the rental truck, plus the replacement of the other 2 vehicles written off by the renters negligence. That rollover definitely had injuries, you do not walk away from that unscathed, you will have bruises, torn muscles, and back and neck damage as well, just not fatal.

Shows they at least put the bumpers out there to absorb impact properly, as the bumpers did the job they were intended to do. Yes granny in the camry was driving inattentively, and range rover will guarantee was on the phone in some way.

You need to watch Russian dash cams as well, where you have dogs, cats and even pigeons using a pedestrian crossing. None so far have shown chickens though. Amazing is that so many Russian drivers stop at them, while others just race through, generally being right on time for the accident.

Francois the object they used is a spark plug, which is hard enough and heavy enough to shatter the safety glass there. Best defence is to put in an anti shatter film on the glass, still will shatter, but now they are unable to gain access via the shattered window, as the film keeps the glass in one piece, like laminated glass.

@Corro_Dedd Because the anger over what he considered to be a massive slight against him was such that he forgot that the car is a driving camera. But as he now has a charge of vandalism against him, which might be taken as destruction of property over the threshold, he now ends up with a criminal record, and if he is in the country on any sort of visa the visa will never be renewed either.

Yes the owner of the truck is at fault for allowing a suspended driver to drive, so can be sued for the medical costs and the balance of the costs to make him whole again. That it might be a new vehicle instead of similar model age is irrelevant, lowest cost will probably be new.

No, just driving like an arsehole, driving too fast for the prevailing conditions. Just because he was 5 under the limit is not going to magically make the tyres grip better when you hit a nice patch of water and start to plane. Should drive according to conditions, not speed limit in heavy rain. Should have been doing under 30 in that condition, like the other drivers on the other side were doing.

Only reason the driver was not cited is because doing so means the cop has to fill in another 2 pages of paperwork. So let the insurance company fill that instead.

@bogglesbiggins1101 Because cops will not bother, and the bike generally is a lot faster than a police car, plus can go through gaps as well that the car cannot easily follow. however the rider probably uses that route often, and it is easy to run a DMV check on all bikes that model and colour in the area, and then see which owners fit the age range of the rider, and then simply go to the registered address, and view the bike. No plate, tow it away, and illegal size the same. But not going to be done, because that takes 3 things the police do not have, ground work, thinking ability (police do not hire intelligent people as basic officers deliberately) and also wanting to be proactive about crime.

Yes, impact hard enough to trigger restraint systems, not the airbags, as the system is smart enough to detect the collision angle and direction, so merely fired seat belt tensioners on the occupied seat to keep the driver from flailing around the interior, and then also commanded the ECU to shut off fuel and disable the engine, plus also automatically unlocked all doors as well. So the driver can still turn off the car, and start it again, though there will be a big warning about safety systems faulty, and that service is required, along with a warning about limited performance mode being enabled. Bosch is clever that way.

Eric simply has to sue the other driver in small claims, for the full amount, plus costs, as it was the other driver who was negligent in clearing their vehicle of snow and ice before driving, which is actually an offense. After all he has video of the vehicle, and the side camera view of the driver. Driver claims to court he was not driving still has to pay as registered owner, then must either have a police report of the theft of the vehicle, dated before the incident, or sue the responsible party they lent the vehicle to instead.

Varies from state to state, many do not even require a roadworthy when buying a vehicle, or even an annual check for fitness to operate. Also varies from country to country as well, many do not require insurance, and then the insurance you claim from your insurance, they pay out then claim back from the other motorist's insurance, or from the other motorist themselves. Really only in the USA is uninsured other party insurance a thing. Here by me all policies come with a high coverage for other party damage, which will cover the damage in most cases, unless you hit a supercar, or total 3 Teslas in a single accident, where you are completely at fault.

No manufacturer will put a full size spare in the back, if there is anything there it is a skinny temporary use one, or a pump and a can of fix a flat. Lighter, so that they can meet that EPA mandated mass and then also save an extra 0.001MPG on fuel use, or in this case an extra mile of range on test track cycle. My car has a full size spare, and my sister got a full size spare for her car as well, as it came with a well for one, just had in it a styrene dummy inner with the jack, spanner and pump, but no spare, cut to reduce mass and cost of manufacture. spare fitted perfectly, and even the dummy fitted in the rear of the tyre. Came in handy when she found one of the myriad potholes that make driving akin to dodgem cars. So thankful my wheels are actually 70 profile, not the more common 50 or less profile, which are basically painted on rubber, and which cause the rim to crack or buckle, and the tyre itself to be destroyed.

Pawel can also ask the parking garage for the footage of the vehicles entering and exiting at around that time, because almost all have very good camera coverage of entrances and exits, and they would likely release the footage for the court case, once asked by a lawyer.

You can see on the big mirrors the dome at the bottom, there to provide coverage of the blind spot next to the vehicle, and often trucks will have an added mirror on the front of the engine cover that provides added visibility in those areas in front as well. The white car was in view of at least the mirrors, truck driver did not look before turning, only a few seconds earlier when merging into the freeway. By me almost all HGV are cab over engine, and the mirrors are in front of the cab, so they cover all blind spots well with the big convex main mirror, and the inset convex bubble mirror at the bottom, if there is not a split section that is convex and aimed down.

@vipermageex5861 Mostly because the video now means the officer now has to add it to the electronic case file, and this extra 30 seconds is time (and hard thinking) away from either dozing in the vehicle, or sitting in a chair at the PD telling tall tales.

A large number probably, and they might do it for many times before they either wreck the vehicle in a single vehicle accident, or have an accident that causes death, and are breathalysed at the scene.

Yes, and every case can so easily be contested in court as well. Simply have exact time of accident, and your lawyer issues a subpoena for call metadata (the carrier will give that, showing active data use or voice use, with no problem) and this then will lead to an additional charge of giving a false statement. Plus being found 100% liable for all damages as well.

@tigerwulff Yes he could have a ticket, or the vehicle could be declared unroadworthy, in that it no longer complies with the original manufacturer specifications. turns out in most areas doing such extreme modifications can make the vehicle unsafe to drive in anything other than a straight line, and worsen the cornering ability as well. Plus there are also regulations about wheels protruding beyond the side as well, he could find himself being sued if he ever scrapes against a pedestrian or another vehicle, and losing the case and the vehicle as well.

Cybertruck is ug leeeeee. Looks like a Toyota TUV, which got the nickname of Totally useless Vehicle pretty fast, being designed as a low cost vehicle, based on the tried and trusted Toyota Stallion pick up, but with flat panels. Not much cheaper, and not popular either.

Sam, 100 % the other driver fault, you were doing a protected left turn, and they did a right on red when there was traffic in the intersection, making them fully responsible for the accident, because they failed to ensure the intersection was clear before doing the right on red.

Yes airbags are what they are called, Supplementary Safety System, they are not the primary safety system, which is the seat belt. If you drive without a seat belt, and are in a collision, the airbags are not going to stop you from being flung out of the vehicle, or keep you from being injured. Reduces injury in conjunction with the seat belt, but not if you are not wearing the belt.

@logitech4873 The screen is Vin locked, along with the ECU and powertrain and battery modules, so you need the Tesla specific software, and an Internet connection, to service the vehicles other than changing fluid and brakes. Fluids as well, aside from brake fluid, are only available from Tesla as well, ordered by the VIN of the vehicle, and only sold to registered repair shops.

Well, because likely last time brakes were serviced was when it was still under warranty, and he stuck black tape over that yellow ABS warning light that has been on for the last few years. Still thinks it is fine "because the truck still stops"when he puts pedal to the floor, even if it does only have a single working set of pads on it, as evidenced by the pulling to the left.

@shimoncohen95 Guy bought a brand new Carrera 4S, and had it totalled, with under 1000km on the clock, in less than a week. Bent like a banana, after being hit on the driver door, and sent 50m down the cross street. He walked away uninjured, and that door was still capable of closing and latching. But written off, more for the chassis being bent badly around the core, and the 14 airbags having gone off to protect him. Would guess he immediately went back and got another one the next day, or at least ordered one. The Fiat Uno that hit him was crushed all the way back to the firewall, engine and gearbox did the impact absorption and folded under the vehicle.

rental van all you need to do is name the rental company as the other party. they will simply put the entire cost on the card the other driver has on file, and as well will make him pay for the damage to their van as well. No need for any sort of waiting for legal, you just sue the rental company direct, they pay up, especially if it falls in small claims territory, and they in turn will go after the van renter for the costs, not caring if the renter was the driver, that is up to the renter to sort out, but pay up first, before you get taken to the cleaners.

Last one at a minimum that bus driver will lose his driving permit allowing him to carry fare paying passengers, which means that he cannot even get a job as Uber driver, only for Uber eats, which pays a lot less. All the passengers on the buses will however be claiming for damages and injury, especially those who were on the impact sides as they likely all got injured by broken glass.

Landscape truck hitch not connected correctly, and they never bothered to put the safety chains on. So while towing it came loose, and when it hit the median likely a can of gas, very likely loose in the back of the trailer, because they had just filled the plastic can, or had filled the grass cutting equipment, came flying forward, and ruptured on impact with either garden tools, or the front of the vehicle. liquid poured out the side, and was lit by the sparks of the side metal scraping on the concrete barrier. You can see from the smoke and the darkish flame, this was 2 stroke fuel mix, the oil only partly burning as it was dripping out of the bottom and sides of the trailer. If it was like any landscaper, the fuel was in a plastic 25 liter container, probably with no lid, as that had long ago been lost, and the fuel had made the plastic yellow and brittle with time.

Plus spilled his coffee.

No 7, with the Toyota driving the wrong way, just bought themselves a nice state trooper vehicle, complete with all the customising involved to get it to state trooper ready. Too bad they will never be able to drive it themselves.

Looks like a lot of the cases here the Tesla driver is driving on what would be classed as unroadworthy tyres, as you can see many with the aquaplaning and rubber in accidents there is either minimal tread depth, or the tyres are worn below the minimum depth, so the car barely has any roadholding in even damp weather, let alone hitting a small puddle at speed. Just because it is an EV does not mean nothing wears, especially in a vehicle as heavy as a Tesla, which is well known to wear out tyres, and the ones rated for use with it are expensive.

@nicoleparreira1024 Likely stored at a yard at the lake, and he stepped the mast for storage, and unstepped when taking out, forgetting it made it a high vehicle. Those masts are not cheap, and they are not cheap to install either, as all the old hardware will mostly need replacing, and then you need to fill the mast with foam as well, after all the runner tubes are in place. too much and you will split it again.

Yes time for Chloe to get a lawyer, and sue the renter for all the damages, plus the cost of the loss of vehicle. The renter can claim somebody stole the truck, but as they were the negligent party in claiming they left it with keys in it, and a quick subpoena for the location of the renters phone location logs will very likely show both active calls and data use, plus also that the location of the phone corresponded with the freeway route at that time as well. Then they can also face the added charges of lying under oath, making a false police report, and insurance fraud as well. Pay the damages plus all legal costs, just needs a phone number, a semi decent lawyer and a subpoena to the phone provider for the metadata for that time period. All the data will be handed over immediately, and will show that the renter was driving, or at least their phone was in the vehicle, and was actively being used, and any calls made or received (the likely cause of the lane departure) can easily be traced back to them as well. Do not think family and friends will want to lie when the result is a 6 month prison sentence.

@m1sba7 South Africa, the owner of the vehicle is deemed to be the responsible party, and they will have to provide details of the driver, though with the minibus taxi industry they simply ignore these as well, and just pay the bribes to keep on running.

@Procrastinator1948 By me the most common form of trailer hitch is firmly attached to the vehicle, not something you can remove without a few minutes and some tools. All the same 50mm ball hitch as well, a standard that all trailer manufacturers have. Otherwise it is a plain pin and loop, and not allowed on public roads, unless attached to a tractor and doing under 20kph. Anything else and it is a fifth wheel, and very few light commercials have a fifth wheel, aside from those with large trailers, that move around things like styrofoam, foam and mattress units.

@TrekkerMoto Mercury switches are long gone from SRS modules, they all use MEMS sensors these days, which are both very reliable, very fast and also position insensitive, so will not give a false output if upside down. The controllers are also permanently powered direct from the battery, so will delay for a few seconds on power being connected for self test, and if upside down will just set a fault code, for the sensors being in incorrect orientation. Central module and then possibly others in crumple zones to provide info on rates of crumple, so the main module can determine impact force and direction, and thus which airbag outputs are going to be fired. Also seat occupancy detectors, so that only the driver and passengers actually in the vehicle are protected, and the others are not fired unless needed.

@chrisruggiero9043 Yes as Amazon is the one supplying the trailer, they will know exactly who was the supplier of the rig that was moving it, and will also have logs of the trailer from the on board tracking unit as well. Time to take them to court, if the amount is under small claims file there, otherwise regular civil court. As they are the owner of the trailer, they cannot disclaim liability.

Military the most fun vehicles are those with the extra plates front and rear "state authorised to exceed speed limits", along with the military registration. Clocked through a speed trap, and the officer just waved at me. might have been the plates, or that he had a mouthful of tacks, and a cable in the one hand, along with a hammer in the other. don't know what speed I was doing, the needle was stuck firmly on 0, other side of the pin.

@Cruor34 Fleeing driver will lose, as he would have been shown to be exceeding the speed limit, and thus the turning driver would have had time to clear the intersection before the other party, who if they were travelling at legal speed, would have arrived there. Plus the whole fleeing the scene screams either they were under the influence, or had something incriminating in the vehicle as well.

No 7 both to blame, trailer driver for changing over an intersection, and car driver for failing to check the intersection was clear before taking the right on red, as an accident doing that is going to be blamed on them for jumping the red light. No8 that van driver has ABS, so he was likely on the phone, and slammed on the anchors while steering to the right, and probably the ABS failed to work because he long ago did not fix that orange warning saying ABS fault, because "it still stops" was his thought.

Quorra can also tell the police about the false statement the other driver gave, and they could investigate him for filing a false police report, which will result in a fine. Then can also sue the other driver for the time he lost, at whatever his hourly rate works out to, plus legal fees. That will possibly educate the other driver a little, on why he should not be a canoe.

No5 report to the local PD, complete with video, citing you are concerned this elderly gent is going to cause a death soon from his poor driving, and that you recommend that he should be checked as to if he should drive. Report to both PD and the DMV. No3 you put in a complaint to the local PD of vandalism, and provide the video. Hopefully somebody sees the video, and knows who it is, and they get publicly shamed for it.

Levi is an ass, in heavy rain you drive slower, just because you can always hit a puddle of water and aquaplane. He might also want to think about this in future, because the next time he might not be so lucky to have flat grass to hit.

Eduardo's mother needs to also probably add a bollard or three at that spot, seeing as it has been damaged before, so either add bollards to demarcate the area off limits, as a way to keep the drivers, likely needing to make a exit from a poor angle, or instead move the drain spout from there, and raise the roof there slightly, or at least remove the existing sheathing, and make it open to the sheet height.

@juliahello6673 Or just wait the 15 seconds for the light to change in heavy traffic, where you cannot see people approaching in the cross lanes. Running a red light is illegal by me, though mostly ignored by the minibus taxi drivers, because those 200 10 seconds in a day do add up to another round trip. Plus they will stop in the middle of an intersection, and in the middle of the freeway, to drop off or pick up passengers.

No8 charged with both failure to obey a statutory sign, and also for failure to comply with a traffic official. Second one comes with a much larger fine, and also a visit before a judge to be sentenced. No 5 yes, driving fast, on a winding road, will result in you stepping out with loss of traction in sharp corners. There is a reason most of those winding roads have a much reduced speed limit, often because the camber of the road is incorrect, due to it being the same as when it was constructed as a flat road a century ago, and most vehicles were incapable of doing more than 40kph, so marking down to 40kph was kept in modern times.

@WastedTalent- Yes the cart is owned by the store, and it is negligence on part of the store to have them roll about. By me you take a cart out, there is a person or ten who will return it for you, though I will often just roll it back to the bay, and walk back to the car. Extra 50 steps either way is not a thing that could be classed as a killer to avoid.

Roger you can also report the driver for attempted insurance fraud, which would result in both his insurer dropping him, plus the bank immediately putting a repo order out on the car as well, as driving without insurance means he broke the conditions for the car loan. Or send the expired insurance along with the claim to the bank, and they will do all that work for him.
