You can't just pay the other person and the gov not charge you. If they have enough evidence of it, they're charging you, regardless. They don't care what you paid. Charges were not brought because there was no evidence of it happening. The payment was to sign an NDA so she didn't go around smearing him with her story. Completely separate.
