Due care means death happened while doing brain surgery due to the instrument accidentally touched other tissues if brain and bled internally. This is not negligence. Here is example of negligence : death happened because the doctor used contaminated toilet bowl and that caused infection and death. This is negligence. Both cases so far the medical practitioners have been evading law. People are creating unwanted hype for each am every reforms.

No. It is clear that whether negligance if present will be weighed only by an officer appointed by court as per rules of the bill passed by govt. Here all investigation will be done by team constituting members of ima ( Indian medical council or authorities or teams containing doctors authorized by ima).

The doctors used toilet tray negligently in which acid detergent was kept and the patient became serous. They evaded these by patching up things later. Under this new law they cant evade these conditions My friend passed away due to doctors negligence. The brain tumour was successfully removed and he was doing good. But later he had to fix stent in brain that he did in appolo ( only appolo is doing that). After fixing stent it became septic. It became infectious. Developing infection is sheer + avoidable negligence of doctors with due care which they didnt. Earlier the doctors used to evade law by covering up issues easily. Under this new law they cannot evade law so they are pissed. Problem in India people are treating professionals or people having lots of degree like God. That's not necessary. Ultimately they cheat you and you are silenced because you dont have money to take it till sc. They tell you you get freelegal aid and all but that also is compromised easily when opposition tips your free legal aid you're gone.
