With regard to custody: the discrepancy mostly occures because the main carerer is more likely to be awareded custody. Courts take note of who knows the names if teachers, friends. They note who makes medical appointments and makes sure they are kept. And they do ask the kids themselves (at least they do that in Germany) which form of custody they would prefer. Unsurprisingly women therefore are granted custody more often then men.

German law knows the concept of Steurungsfähigkeit for that very reason. The court has to establish that the person was able to control their actions well enough to assess a situation and control their actions.
