18:00 - The flaw in the Supreme Court's reasoning there is that punitive damages aren't determined by the amount of money the defendant needs to give the plaintiff to compensate them for the harm suffered; they're determined by the amount of money you need to fine the defendant to deter them from doing it again. Requiring punitive damages to be proportionate to compensatory damages would defeat the whole purpose of punitive damages, which is (as the name suggests) to punish the offender, rather than to compensate the victim.

One major difference between this and the Streisand case: the picture of Streisand's house wasn't labelled or distinguished in any way that would identify it as her house to a casual observer. The IG post of Jacksfilms's house was specifically called out as his and his family's residence.

I wonder... what's stopping the rest of the U.S. judicial system from simply ignoring this ruling? The Supreme Court has no power to compel adherence to its rulings; the only reason they're generally obeyed is that the Supreme Court is respected as a (theoretically-)impartial arbiter of the law. If the Supreme Court shatters that respect by making a ruling with no factual basis whatsoever, what stops the lower courts from acting as if the Supreme Court is incapacitated and simply defying said nonsensical ruling?

Why do the courts even give deference to assessments and determinations by government entities in the first place? If you're in court and the prosecutor asks why you killed your neighbor, you can't just say "I determined that it was necessary to kill them", you have to justify your decisions and actions to the court. There's no reason why government entities shouldn't have to justify their own decisions and determinations in open court. Oh, and we also need a law to prevent the government from submitting classified information as evidence in court, and to automatically declassify any classified information required as evidence by a party opposing the government in court.

@Lobsterwithinternet Except that even with immunity, the defendant needs to go to court to get the case thrown out anyway, so giving people immunity doesn't actually save that time, energy, and money. It just means that the grounds for throwing out the case're different, and that people with legitimate grievances get screwed over.
