The source of the "problem" is the marginal intelligence of the majority of human beings, endemic and intractable. This is the central, though, unspoken, problem of governance; and it's fundamentally a communication issue: how do you communicate with someone who doesn't understand?! You can make a law, display it, and find, after it's violated, that the violator wasn't duly impressed by it. Self-regulation, self-control, is a function of intelligence. Finding these features lacking, you'll find intelligence lacking, too. What's more, there's nothing that can be done about it! I mean, short of genetic reengineering...
