Had Disney themselves just come out and said that they leased the restaurants to other companies, I would have been a lot more understanding of why they initially didn't claim liability. No one should be held responsible for the actions of a third party who rents a space from you, you're not physically there to make sure they're not screwing up and you can't physically be at every one of your properties all the time. That being said, I still don't agree with their arbitration clause; I can think of a myriad of other reasons and scenarios as to why that would be scummy.

Like you said, no one is going to risk a criminal conviction for just 1 vote; or 7 per year. While 7 fraudulent votes per year is the average over 20 years, that isn't how their actually cast. It's more likely that they are cast in the hundreds at least to make the fraud effective at all

I do believe that a fortune tellers say something along the lines of the winning lottery numbers and get it wrong that anyone who chooses those winning lottery numbers should be able to sue them for fraud. It's one thing to whip up a story about your dead Grandma saying they love you, it's another to tell them something that convinces them to invest in something that won't pay off or some similar situation.

The Supreme Court really should have made exceptions for hate speech laws in regards to examples like allowing Nazis to parade through Holocaust Survivor towns, this expression I'm Free Speech service to do nothing other than agitate and bring back old trauma in the minds of residents. It is not productive it is harmful, if Nazis want to express their views then they can do it around people who care about it, online, or at home.
