  1. Congress DOESN'T have to. "individual" is not defined in the code. It is defined in Treasury regulations. That means if "individual" is defined not as a US citizen, a US Permanent resident, or a person who meets the presence test. It would mean that citizen is removed as criteria and bona fide residence, or meeting the terms to qualify for the FEIE makes you a non-resident.

  2.  @robjus1601  the current statute DOES NOT DEFINE who is subject to that tax it just says individual. The Treasury regulations define an individual and who is and is not included. It can be changed with a simple change of the definition.
