The executive branch has learned that it can do whatever it wants to and nothing can stop them. File a lawsuit? Take a hike! Lose in the courts? You and what army are going to "enforce" the ruling? Vote them out of office? Meet the new boss, same as the old boss.

@nk-dw2hm It's not the job of Colorado, nor any other state, to "try" someone on a Federal, Constitutional issue. It's a federal issue and must be tried in the federal court system. Now, just to show you my interest here, ponder this: Since the outcome of the dispute is well-defined, i.e., the loss of eligibility for president, it could very well be argued that since neither liberty or money is at risk then the due process/equals protection clauses don't apply. But if they didn't, don't you think that it would have been specifically spelled out?

@nk-dw2hm Name ANY amendment that a violation of requires a conviction. The problem is that there are a lot of vagueness and assumptions built into the constitution. To your point, why then couldn't your local magistrate find someone guilty of insurrection?

@M-A-R-V-I-K If Section Three is not subject to due process then why is any other section. US vs. Powell teaches us that, among others, Trump is entitled to a day in court. Because this is a Constitutional issue, Powell was tried by a circuit court, and Trump gets the same thing. Powell also had a trial by jury, something else that's guaranteed. You don't get to pick and choose what parts you like.

So, let's see...based upon US vs. Powell, 1871, we learned that a lowly county constable, charged with violating Article 3 years before the amendment was even proposed, received his equal protection and due process rights, being tried before a US Circuit Court, and perhaps most importantly, a jury of his peers. The North Carolina Supreme Court didn't try Powell. The North Carolina Secretary of State didn't declare Powell ineligible. If a constable received such protection then why shouldn't a president?

Opponents cited the unreliability of the automobile and its unpredictability to suddenly catch fire. Sound familiar?
