  2. It is very easy to say she should be charged, but what would be the point? She was very clearly way out of her depth in the job and should never have been given it. No criminal intent, just sheer incompetence. The fault lies in the system that made her a candidate and in the person who approved her appointment. That is the person who should face consequences.

  4. When non-compete agreements were very uncommon, American technology leapt forward and America was very competitive. What used to happen is that researchers working for Company A would have a good idea, but management were for whatever reason not interested. To the boffins with the idea would leave and form their own company, develop their idea, and do very well out of it. But Company A would do well too, because they had been around a while and customers knew they were good. Sometimes Company A would undercover a common product problem, and put their boffins onto solving it, which they did. This would make Company A outcompete Company B, so B would offer A's boffins more money and poach them. So the intellectual property got transferred, and both sets of customers benefited, the two companies kept their market share, and everyone actually is happy. Really, if a company finds it necessary to get its workers to sign non-compete agreements, mostly its a case that they risk workers leaving if they aren't paying enough, or not providing good work conditions, or they have some leverage that prevents people from leaving.

  5. He was 150 yards away behind the building. Nobody that counted would have heard him. Presumably he used his radio as Ted Cruz said, but apparently nobody has yet asked the FBI if he did. Actually, he should have repeatedly fired his handgun into the roof. The noise might not be heard but probably would, and if so would have triggered the SS agents with Trump to pull him down.

But all she had to do was say "I can check for you, but from memory it is about so many percent." She said she didn't know, under oath - we must conclude she simply doesn't know. This means the silly woman doesn't care whether or not the system she controls works - which was the point Sen Kennedy was making.

If a defendant in her court answered like that, she wouldn't believe him. And neither would anyone else. Arrogant woman, not very smart: By telling Kennedy that she can't say if he read her words correctly as she doesn't have her writings in front of her, she is more or less stating that Kennedy may be a liar. Which is about as likely as the sun turning green. This is standard Kennedy any time he smells a dud nominee. Don't these idiots bother to come prepared? A supervisor once told me when I was a young lad, "Always tell the truth, don't think about it. Then you don't have to remember what you said." Apparently not something this fool woman understands.

He was still a TV executive producer. And it was Putin who sent the troops in again three years ago, remember. By then Zelensky was president, and it was his duty to resist that 2nd invasion.

  13. Part of the reason why there is an SS is the same reason why some filthy rich business men and the odd movie star surround themselves with flunkies in dark suits. It's a status thing - it says "I'm filthy rich and can afford flunkies unlike you peasants" and it helps them actually feel more important. US presidents seem to find having body guards and motorcades important, it's not all about protecting them from being shot at. Other major nations in the world don't seem to need an SS, except for the ones led by a dictator. Its why the US President has marines standing to attention about the place - its just a badge of status. Same as old time kings wearing a crown. When US presidents come here to Australia, they bring the US Secret Service and all the specially built limousines with them and request motorcycle outriders, and totally disrupt traffic. It is quite unnecessary on security grounds - our own political leaders don't bother with it and just go about in a chauffer driven Ford Fairlane. Of course, in the USA there is a need for some protection, since the USA has such a big population, so there are lots of nutters - as Trump having his ear shot demonstrates. And the US stupidly allows anyone and everyone to own a gun for no good reason - the only developed nation in the world to do so.

If I was a cop and climbed up a ladder to see what's going on and, when I poked my head over the top, saw a villain pointing a scoped sniper-grade rifle straight at me, I would immediately descend pretty rapidly too. I can't protect Trump with a bullet between my eyes. But hopefully I would then immediately make a radio call. He most likely did - that's what cops are trained to do. Trouble is, the SS were not able to hear cop radios - they were on a different net. You are right - that was a disgrace. There is another aspect. I once worked for a 2-way radio company. We supplied the local cops with a "man down" option. This is meant to alert other cops that a lone cop has been brought down in a fight or has been shot. If the radio is horizontal, it automatically sends out a "man down" signal with his GPS location, received on all other cop radios in the area. Cops by nature are really keen to protect their own, and if their own radios get a man-down code they all WILL react. If I was the cop who had the shooter point at me at the Trump rally, I would hold my radio horizontal, and send an alarm faster than I could talk. It would certain produce an immediate dramatic reaction in any cop field control truck/van, which I would assume was deployed for the Trump rally.

  15. He's tried 1500 cases. Kennedy found about a dozen that were reversed or partially reversed.so the guy got it right about 99.2% of the time - that seems pretty darn good. Kennedy here used his usual technique to see if he could unsettle the guy. Unlike many others who could not stand the heat or started filibustering or lying, this guy remained calm and gave succinct direct and honest answers. I hope he got voted in.

Colateral estopel is the principle that you shouldn't try to litigate the same matter twice. you either appeal on the basis of error in procedure by the court, or you accept what the court decided. Colateral estoppel is an archaic, obsolete term - it is usually called these days as issue preclusion.

  17. Interesting. Here in Australia, some companies have tried writing such 2 year exclusion clauses into employment contracts. Hardly anyone takes much notice. It could be held as restraint of trade if it went to court. What sometimes happens is that a person who leaves a company with a 2 year clause not to compete, finds a job with another company with a different job title, but doing much the same thing. In highly specialised fields like medicine and engineering, it could cost the first company a lot of expense on legal fees to prove in court it is the same job. So they don't sue, because not only will it cost them, the suit may fail, and the competitor would most likely find another person just as good anyway. Kennedy is right. The doctor was fool enough to sign a contact he didn't like, just so he didn't have to move house and got a bag of money instead. Not really any different to signing a contract to buying an EV car, finding the need to find places to charge it at a damn nuisance, and wanting your money back.

  18.  @JD-xd4sy  What the strategy has been is to wear Russia down so that Putin eventually concludes it is just too darn expensive, plus keep the war going long enough so that Ukraine can develop its own means of taking the war deep into Russian territory. If troops from third party countries went to Ukraine and fought on Ukraine's side, that could lead to widespread war - and European countries have been careful to not send troops for that reason. Third party countries cannot launch planes or missiles from outside Ukraine as that would certainly lead to world war - so they have not done that. But if Ukraine finds its own ways to attack targets deep within Russia, Russia has no justification to widen the war to outside Ukraine. Just supplying arms, of course, to the weaker side is unlikely to win a war for them. To win a war you have to take the fight to the enemy's territory. This is what Zelensky understands, European leaders understand , almost certainly what Putin understands, and what Trump does not understand.

For an employer's point of view, they are usually better off without the disgruntled worker anyway - they can replace him with somebody better. For an employer to try and prevent a worker from going to another firm or start one, is restraint of trade - restraint of trade is illegal in most if not all Western countries.

  24.  @danielgrohl6971  It is a long standing tradition in the adversarial court system (trial with prosecution and defence) that judges pride themselves on bringing no knowledge or opinions to any case they try ("professionally dumb", as a lawyer explained to me), as they are supposed to try cases solely on the evidence presented in court bey the prosecution and defence. This is one of the basic principles of democracy. Senator Kennedy knows this. Has it occurred to you that Kennedy is trying to trick the nominee, and that the correct answer is in fact no answer? How do you know if Kennedy in fact voted for the guy, on the basis that he could not be tricked nor bullied?

Clearly a lot of it is for show, or the US Government has fallen for some good old fashioned empire building. They have about 300 people per VIP, yet utilize local police on parades and rallies as well. It is certainly not clear that its all necessary. Trump got shot because the morons did not secure a roof, not because they didn't have enough people. J F Kennedy got shot because they didn't bother to check a little-used building overlooking the motorcade route. What has been shown is that their leadership are incompetent.

They have, by various ill-thought out government policies and laws, sent manufacturing off shore, mostly to China. And every now and then, the US increases its legal borrowing limit, so it can borrow more money - from China. It may not be long, as China is ascendant, that China calls the tune, not the USA. Far from it being the USA that must ensure the cooperation of China, it will be China that enforces what the USA must do. If the USA does not become carbon neutral on its own volition, China may take steps to ensure that the USA does so or its economy collapses.

  38. Rubio is very articulate, a good salesman, but that does not make him right. Rubio said several times that Trump has been making deals all his life. But Trump's deal making has not been very good. Quite a few of his deals have gone sour, and led to him being bankrupt several times. A good deal is a deal that enriches both parties - a fact that Trump does not clearly understand. He also needs to understand that if the war in Ukraine is ended, regardless of the circumstances, Putin will wait a bit, then attack again, either Ukraine or another country - hence Putin must be shown that starting wars just doesn't pay. It is not a matter of meeting Russia's needs and meeting Ukraine's needs as Rubio claimed. It is a matter of meeting Europe's needs.

  39. Fauci may have been doing the job as best he could, but his testimony leaves a lot to be desired. He said its a physical impossibility for him to check for himself the validity of each proposal' because there are thousand of them. He has to trust his subordinates to get it right. This means the approval process is flawed. He is not accountable because he trusts subordinates. But the subordinates are not accountable either because he has final authority. So nobody is accountable. It is a basic and vital principle in business of any kind that authority must be delegated to match ability. He should have had a number of delegates authorised to sign off on whatever they are expert in. Then they are accountable. Fauci's role should be to monitor these delegates to see that they maintain their expertise and do a good job - and sign off on the paperwork for that.

A neighbour 3 doors away from my house has a Harley Davidson - the sort of bike that just has three feet of pipe for an exhaust system and no mufflers. I only hear it if the wind is blowing from his direction, or he rides it past my house. I guess that cop was not as brave as the SS agents who surrounded Trump.

But I think part of the problem is that the SS were not spread about as they should have been, only the local cops, and they did not have direct radio contact with the SS. Messages had to be verbally relayed and that took too long. You and I both agree that the whole thing was a disgrace though. The shooter should have been intercepted long before.

Having stayed considerable time in gaol, his androgen levels will fall anyway. I can think of only two reasons:- # you are seeking an unfair advantage at a pistol shooting club, or, # you want to be sure to kill the guy you wish to murder. Only in the USA do you hear such nonsense as this senator's speech. He said that pistol braces are for disabled (eg one-armed) people. But the he said millions of Americans own them - so most pistol braces are not owned by disabled people - they are fr outnumbered by able people.
