  1.  @leighannclements7849  It's an opening statement, not a total summary. Clearly states he drove at officers vehicles. It doesn't state it was dark though so with your logic perhaps it was daylight.

He was asked 12 times to exit the vehicle, with the vehicle flagged for firearms the day before, and him having numerous firearms convictions they were forced to shoot to stop him endangering Police and the Public.
