@ishitunot5152 Okay, so your point here, is that this man was too drunk to drive, but how did the cops know that he was too drunk to drive?
Well, he admitted to drinking. He was driving. He passed out while driving. He admits to drinking too much to drive. He doesn't know where he is, he doesn't even know what city or county he is in, even though he grew up there. He doesn't remember what he had been drinking and can't get the amounts correct.
Honestly, just admitting to drinking too much to drive is pretty damning in itself. He tried to play it off that he wasn't driving, but the cops have evidence that he was driving and his story collaborates that evidence.
Then he takes a field sobriety test, which he failed. Sober people can fail those though, so they aren't really useful by themselves. However, if you have that on video AND a breathalyzer, it is easy to get a conviction. So, then they ask if he will take the breathalyzer and he fails that too.
