Fifty years is essentially a life sentence. It doesn’t solve the real threat, which is that the truck owner who put him on the road in a heavy truck is still in business under a different company name. Incompetent drivers are directly responsible for wrecks, but there is a system which put them on the road which continues to be a threat.

Even the judge and district attorney think the sentence is too long. It is an artifact of mandatory minimum sentencing law which requires consecutive sentences in some cases. Freeing him is not appropriate, though. It must be made clear that incompetent drivers should not be driving heavy trucks on our public roadways.

@wahhbajack — The experiments had nothing to do with it. As an undergraduate, he participated in some psychology studies. Countless college students have done that. Kaczynsky himself said that it was not an extreme experience.

@Lorimars319 — You have not been following this at all, it seems. You cannot get out of a vehicular homicide charge simply by claiming your brakes failed. Competent truck drivers do not rely on their service brakes to come down a hill safely. Before reaching the downgrade they must slow to a safe speed for the grade, then use gearing and engine braking to control the speed. If the driver believed he had a brake problem, and there was evidence that he did, then he should not have attempted to descend the grade. For that matter, he should not have driven the truck further until it was repaired. If you drive a heavy truck or are planning to do so, you should learn something from this incident before you get in similar trouble.

After the legal process has run its course, the Governor of Colorado might make a reduction in the sentence. All this will take some time, so there is no point in beng impatient. I don’t know what you mean by “clemency.” That just means moderation of the severity of the punishment. If you are expecting that somehow he will get off, I think you should forget about it. He killed four people through his reckless operation of a vehicle, and that deserves a significant sentence.

It isn’t that easy to compare criminal cases. Different facts. Different charges. Different states with different laws. Different juries. There is no general rule that can be drawn from these two cases because neither is typical.

Breaks do not get “lost.” If the truck had brakes, he could not have made it from texas to Colorado. The fact that he said he lost his brakes is incriminating, because it means he was expecting his brakes to control his speed on a downgrade. The only way the speed of a heavy truck with a load can be controlled on a downgrade is by getting into a low gear before starting down the hill. Most likely he destroyed what brakes he had on that hill.

All that means is it isn’t murder. Anybody who drives needs to understand this. If you run over someone, just saying “I didn’t mean to hurt anyone” doesn’t get you off.

Professionals are trained to handle emergencies. Think of Captain Sullenberger, ditching an airliner in the Hudson River with no loss of life. We need better training and certification of truckers because this driver was clearly incapable of dealing with an emergency. His lack of training and poor crisis management skills do not get him a pass, however.

The defendant was offered a plea deal which would have dropped most charges. He wanted a trial, so the DA filed every charge she could support. That’s the way the system works. The jury did acquit on 15 charges, so he could have fared worse.
