The sentence is unreasonably high, but it is hard to decide what is reasonable without knowing how much he was negligent. These articles always say “his brakes failed” or “he lost his brakes.” More likely, he destroyed his brakes by improper operation of his truck. Heavy trucks use low gears to control speed on downgrades, not service brakes. What gear was he using to start down the grade? Was the grade marked? Could he read the grade sign? What training did he have? Was he properly licensed for heavy trucks? Can a driver be licensed without demonstrating knowing how to take a downgrade safely?

The brakes were not the cause of the wreck, despite all the talk about them. Truckers do not depend on brakes to get down a hill. Low gears, supplemented by a Jake brake, are used to descend a hill. Very little use of service brakes should be required. There was evidence that he knew his brakes had been overheating before he got to that grade, yet he went ahead, probably in too high a gear.

“Accident” is not a helpful word in determining criminal culpability here. It means only that he did not intend to kill or injure anyone. That is why he was not charged with murder. Criminal culpability depends on whether he was negligent. The jury found that he was. You don’t get off just because you did not intend to kill someone.
