  4. That’s an interesting issue. It depends upon when the law determines the attempted auto theft conspiracy to have terminated. The other two ran away but Miles separated himself from them by running in a different direction. For felony Murder 2, the murder must have been committed “in the course of” another major felony. Auto theft is a third-degree felony so might not be classified as a qualifying felony for Murder 2. Carjacking would qualify as a major, F-2 felony (robbery). I forget whether they were being investigated as conspiracy to carjack versus regular car theft of unattended cars. Again, it seems to depend on whether the aftermath/ flight was in the course of the initial crime. I would charge the other two also with criminal homicide/ murder. They can’t be found guilty of Murder 1. I think he said they’re juveniles so they’re ineligible for death penalty anyway. They probably will let them plead just to the auto-related felonies, especially if they cooperated by giving statements. I assume they gave up Miles, especially since I think one of the others is Miles’ brother.

  49. Yes, Cardinal Avenue is to the south of Old Lancaster Avenue and North 54th Street. There already is a pedestrian bridge over City Avenue between McShane Hall on the Montco side and the school library on the Philly side near Cardinal Avenue.
